Recht auf Freiheit und Sicherheit (Art. 5 Abs. 1 EMRK); Sicherheitshaft im Hinblick auf einen späteren richterlichen Entscheid, vor dem Inkrafttreten von Artikel 364a f. StPO.
Die sechs Fälle betreffen die Sicherheitshaft der Beschwerdeführer im Nachverfahren während verschiedener Zeiträume zwischen 2018 und 2020. Die Sicherheitshaft war – vor dem Inkrafttreten von Artikel 364a f. StPO – gestützt auf analog angewandte Bestimmungen der Strafprozessordnung zur Untersuchungshaft angeordnet worden, bis die Gerichtsentscheide zu den Anträgen auf Verlängerung der stationären therapeutischen Massnahme, die mehrere Jahre vorher angeordnet worden war (Nr. 18875/19, 17715/20, 42059/20), und/oder zu den Anträgen auf Verwahrung der Beschwerdeführer (Nr. 30384/19, 17715/20, 40876/20) vorlagen. Der Gerichtshof warf bei allen Beschwerden die Frage auf, ob den Beschwerdeführern unter Verletzung von Artikel 5 Absatz 1 EMRK die Freiheit entzogen worden war, und insbesondere, ob die Inhaftierung während der betreffenden Zeiträume «auf gesetzlich vorgeschriebene Weise» angeordnet worden ist. In zwei Fällen (Nr. 30384/19 und 42059/20) stellte er ausserdem die Frage, ob die Beschwerdeführer für die Inhaftierung unter Verletzung von Artikel 5 Absatz 1 EMRK ein effektives und durchsetzbares Recht auf Schadenersatz gemäss Artikel 5 Absatz 5 EMRK hatten.
Die Fälle gleichen dem Fall I. L. gegen die Schweiz vom 3. Dezember 2019 (72939/16), in dem die Schweiz wegen Verletzung von Artikel 5 EMRK verurteilt wurde. Die Parteien konnten sich in diesen Fällen gütlich einigen. Im Register gestrichen.

FACTS AND PROCEDURE
The applicant's details are set out in the appended table.
The applicant was represented by Mr S. Suter, a lawyer practising in Basel.
The applicant's complaint under Article 5 § 1 of the Convention concerning his detention for reasons of public safety (
Sicherheitshaft
) from 5 January until 19 August 2019 (226 days) ordered on the basis of provisions from the Code of Criminal Procedure governing pre-trial detention, applied by analogy, pending a court ruling on a request for an extension of the institutional therapeutic measure (
stationäre
therapeutische
Massnahme
) imposed on him several years earlier was communicated to the Swiss Government ("the Government").
The Court received the friendly-settlement declarations, signed by the parties, under which the applicant agreed to waive any further claims against Switzerland in respect of the facts giving rise to this application, subject to an undertaking by the Government to pay him the amounts detailed in the appended table. These amounts will be payable within three months from the date of notification of the Court's decision. In the event of failure to pay these amounts within the above-mentioned three-month period, the Government undertake to pay simple interest on them, from the expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points.
The payment will constitute the final resolution of the case.
Erwägungen
THE LAW
The Court takes note of the friendly settlement reached between the parties. It is satisfied that the settlement is based on respect for human rights as defined in the Convention and the Protocols thereto and finds no reasons to justify a continued examination of the application.
In view of the above, it is appropriate to strike the case out of the list.

For these reasons, the Court, unanimously,
Decides
to strike the application out of its list of cases in accordance with Article 39 of the Convention.
