(2ème rapport trimestriel 2022) Droit à la liberté et à la sûreté (art 5 § 1 CEDH); détention pour des raisons de sûreté en vue d'une décision judiciaire ultérieure, avant l'entrée en vigueur des articles 364a s. CPP. Ces six affaires concernent la détention des requérants pour des raisons de sûreté, pendant diverses périodes entre 2018 et 2020, qui avait été ordonnée - avant l'entrée en vigueur des articles 364a s. CPP - sur la base de dispositions du code de procédure pénale régissant la détention provisoire, appliquées par analogie, dans l'attente de décisions judiciaires soit sur des demandes de prolongation de la mesure thérapeutique institutionnelle prononcées plusieurs années auparavant (nos. 18875/19, 17715/20, 42059/20) et/ou sur des demandes d'internement des requérants (n° 30384/19, 17715/20, 40876/20). La Cour a posé la question commune si les requérants ont été privés de leur liberté en violation de l'article 5 § 1 de la Convention et, en particulier, si leur détention pendant les périodes pertinentes a été ordonnée " conformément à une procédure prévue par la loi ". Dans deux affaires (nos 30384/19 et 42059/20), elle a en outre posé la question si les requérants avaient un droit effectif et exécutoire à une indemnisation pour leur détention en violation alléguée de l'article 5 § 1, comme l'exige l'article 5 § 5 de la Convention. Il s'agit d'affaires similaires à l'affaire I.L. c. suisse du 3.12.2019 (72939/16), dans laquelle la Suisse a été condamnée pour violation de l'art. 5 CEDH. Les parties sont parvenues à un règlement amiable dans ces affaires. Rayées du rôle.

Having regard to the formal declarations accepting a friendly settlement of the case,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant's details are set out in the appended table.
The applicant was represented by Ms K. Gruber, a lawyer practising in Vevey.
The applicant's complaint under Article 5 § 1 of the Convention concerning his detention for reasons of public safety ( Sicherheitshaft ) from 2 September 2019 until 18 May 2020 (259 days) which had been ordered on the basis of provisions from the Code of Criminal Procedure governing pre-trial detention, applied by analogy, pending a court ruling on a request for his internment ( Verwahrung ), was communicated to the Swiss Government ("the Government").
The Court received the friendly-settlement declarations, signed by the parties, under which the applicant agreed to waive any further claims against Switzerland in respect of the facts giving rise to this application, subject to an undertaking by the Government to pay him the amounts detailed in the appended table. These amounts will be payable within three months from the date of notification of the Court's decision. In the event of failure to pay these amounts within the above-mentioned three-month period, the Government undertake to pay simple interest on them, from the expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points.
The payment will constitute the final resolution of the case.


Considérants

THE LAW
The Court takes note of the friendly settlement reached between the parties. It is satisfied that the settlement is based on respect for human rights as defined in the Convention and the Protocols thereto and finds no reasons to justify a continued examination of the application.
In view of the above, it is appropriate to strike the case out of the list.


Disposition

For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases in accordance with Article 39 of the Convention.
